Benefits of Divorce Mediation

Divorce proceedings may call to mind images of soon to be former spouses battling it out in the courtroom. Fights about alimony, child support, division of assets, and more may be associated with this. This, however, is not how divorce needs to be. In fact, the more amicable the divorce, the more likely that divorce proceedings will be less expensive, less time-consuming, and less stressful. Coming to agreements with a divorce pending, however, is much easier said than done. A mediator can act as a neutral third party to help facilitate you and your spouse working together to resolve all key issues incident to divorce.

What are the benefits of divorce mediation?

Mediation is a means of dispute resolution where two or more parties come together with a third party mediator to help the parties negotiate a mutually agreeable settlement. In a divorce mediation, the mediator works as a neutral third party to help two spouses navigate the issues involved in divorce, such as division of the assets, alimony, and more in order for them to reach an acceptable agreement that they may submit to the court. There are many benefits to this approach to divorce.

If there are children involved, divorce mediation can provide invaluable benefits. With mediation, you can shield your children from many of the stresses that come from parents going through a divorce. Mediation offers more privacy than going to court for public hearings. The mediator will not only focus on you and your spouse, but your children as well and help you both work towards a resolution that takes everyone’s best interests to heart. Children also receive other benefits associated with mediation, such as reduced stress on all parties and preservation of goodwill between the parties.

Going to court is stressful. There is something daunting about entering a courthouse to speak before a judge. Mediation is much less overwhelming. It is a small meeting of parties and a mediator who are looking to come to an agreement on some important matters. It is a collaborative effort that ends up giving you and your spouse more control over the process. You decide the outcome together instead of leaving it up for a judge to decide.

As previously mentioned, divorce mediation is also usually more cost-effective and less expensive than a litigated divorce. Litigation is expensive and can take a lot of time to get through. Divorce and post-divorce life can be expensive. Divorce mediation can be a way to save a significant amount of money and reduce the financial burden for both parties.

Divorce mediation only works when both parties are willing to work together to reach an agreement. The collaborative aspect of divorce mediation can help to preserve and foster a spirit of teamwork between the divorcing parties. Despite their marital differences, they will come together to make the process work. This can be invaluable to post-divorce stability, especially when there are children involved. It can help establish a positive post-divorce co-parenting relationship.
